This Privacy Policy applies to Gentle [hereinafter referred to as the “Website”] and the services provided by NEOGENTLE TECHNOLOGIES PRIVATE LIMITED (“NTPL”) on the Website. The Terms and Conditions of Use, as available on the Website, are incorporated in this Policy by reference.

NTPL is committed to respecting and safeguarding the privacy of information that it collects, receives, possess, stores, deals or handles from any person who visits, browses, uses or accesses the Website or avails of the services provided by the Website [“User”]. This Privacy Policy [“Policy”] makes all necessary disclosures as required under the Digital Personal Data Protection Act, 2023 and the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 [“Applicable Law”] in relation to dealing with the personal or sensitive personal data or information collected by NTPL and/or received from Users of the Website [“Information”]. This Policy is applicable to all Information that is disclosed by and/or received from the User.

NTPL reserves the right to modify or review the provisions in this Policy at its sole and absolute discretion, and the revised/modified Policy will be in effect from the day it is uploaded on the Website. NTPL shall cause the modified/revised Policy to be circulated to its registered Users, at the e-mail address provided by them at the time of registering with the Website. All Users not registered with the Website for availing its services and/or have not provided any Information are requested to periodically visit the Website and review the Policy.

INFORMATION NTPL COLLECTS

NTPL collects many kinds of information in order to operate effectively and provide you the best services and experiences we can. Some of this information you provide directly to us. Some of it we get by observing how you interact with our website and the services provided by it. When you are asked to provide Information, you may decline. But if you choose not to provide the Information, you may not be able to use some features or services, and the User must not proceed with using the Website. By continuing to use the Website or the services of the Website, it shall be understood that the User has consented to this Policy and the Terms & Conditions of Use of NTPL

Information NTPL collects includes:

(a) When you sign up to use the Website or services you may be required to provide information about yourself, such as your name, birthdate and contact information etc

(b) To avail of the services, you will need to sign in with an email address and password, or via Sign in with Apple or Google Sign-In, in which case we receive your name and email address from Apple or Google as applicable.

(c) We collect information that tells us how you interact with our services, including the browser you're using, your IP address, location, cookies or other unique IDs, the pages you visit and features you use.

(d) If you contact customer support or raise a support ticket, and choose to attach a screenshot, photo, or video, we access your device camera, microphone, and/or photo library solely to let you capture or select that attachment — these are only accessed with your explicit permission and for this purpose.

(e) If you provide a GST Identification Number (GSTIN) for billing purposes, we store it to generate accurate invoices for your purchases.

(f) While browsing through the Website, the Website server may automatically record some general information about the User's visit, such as the date and time of visiting the Websites, the IP (Internet Protocol) address being used, the type of browser being used and other statistics ("Log Data"). It is expressly clarified that such Log Data collected is not sensitive personal data or information as defined in the Rules and for the purpose of this Policy. NTPL does not use Log Data for marketing or advertising purposes, or share it with third parties for such purposes; it is used solely to operate, secure, and troubleshoot the Website, and, together with the Customer Support, account, and purchase information described below, to analyse usage patterns and improve the Website, and may be shared, where necessary for those purposes, with the service providers described under "Sharing and Disclosure of Information" below.

NTPL will not be responsible for the authenticity, correctness or completeness of the Information provided/supplied by the User, or any consequences arising in relation to incorrect or incomplete Information.

PURPOSE OF COLLECTION AND USAGE OF INFORMATION

NTPL uses the information it collects to operate, improve and personalize the services it offers on the Website. Information disclosed to NTPL by a User will be used by NTPL for one or more of the following purposes:

(a) to assist NTPL in creating content that is relevant to the User;

(b) to determine the periodic nature of the services NTPL intends to provide Users;

(c) to maintain a database of all the Information collected from the User;

(d) to communicate with you, for example, informing you when a subscription/service is ending, letting you know when offers/promotional codes are available or letting you know when you need to take action to keep your account active.

(e) to evaluate and to administer the Website and resolve any problems that may arise with usage of the Websites;

(f) to use the Information to improve the quality of services, understand user trends and for such other lawful purposes that NTPL finds necessary in furtherance of customer satisfaction and their business;

(g) to analyse your Customer Support interactions (such as support ticket history and resolution), account/User identifiers, and purchase and subscription history, in order to understand usage patterns, evaluate and improve our Services, and measure support quality ("Analytics"). This analysis is conducted by NTPL for its own business purposes and does not involve sharing your Information with third parties for advertising or marketing purposes.

NTPL may also use the information for the purpose of Web logging, which enables it to collect the standard information your browser sends to every website you visit. NTPL will collect Information only for a lawful purpose connected with the functions and/or activities of NTPL, for which activities the information sought is considered necessary.

PAYMENT DATA

When you make a purchase on the Website, your payment is processed directly by our payment gateway partners (currently Razorpay and Cashfree, both PCI-DSS compliant payment aggregators regulated by the Reserve Bank of India) or, for purchases made on iOS through Apple's In-App Purchase system, by Apple. Your card or bank details are provided directly to these partners and are not received, viewed, or stored on NTPL's own servers at any point. NTPL only receives confirmation of whether a payment succeeded, along with limited billing details (such as your name and billing address) necessary to generate invoices.

NTPL shall not be responsible for any defaults or loss-causing actions of such payment partners while the User is transacting on their platforms.

COOKIES

When a User visits the Website, one or more cookies shall be sent to the computer or device used by the User to visit the Website. Cookies are used to improve the quality of the services provided by NTPL, including for storing User preferences, improving search results and tracking User trends.

Cookies may include an anonymous unique identifier and may be stored on the User's hard drive. Like many sites, NTPL uses cookies to collect information. Users are given the option of disabling cookies via their browser preferences and the same must be done at their instance and accord. However, Users are advised and made aware that if they disable cookies on their browser, some parts of the Website may not function as effectively as they are intended.

SHARING AND DISCLOSURE OF INFORMATION

Only persons authorized by NTPL shall have access to Information supplied/provided/ disclosed to NTPL. By providing Information the User hereby gives its consent to NTPL for sharing the Information with NTPL's partners, employees, associates, officers, lawyers, auditors, agents and/or affiliates. NTPL may disclose Information if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to respond to subpoenas, court orders, or other legal process.

DISCLOSURE TO THIRD PARTY

In the event Information is collected and retained by a third party, on behalf of NTPL, NTPL shall obtain prior permission from the User before transfer/disclosure of Information to any such third party, unless such disclosure is necessary for compliance of a legal obligation or statutory duty. NTPL may share Information with any company or person located in India or otherwise if the same is necessary for the performance of lawful contract between NTPL and such person/entity.

NTPL undertakes to carry out necessary diligence to ensure that the concerned third party employs the same level of data protection that is adhered to by NTPL. NTPL cannot be held accountable or liable in any manner whatsoever for any loss of confidentiality attributable to actions of such third parties.

SECURITY

NTPL takes all reasonable security practices, measures and precautions to keep the Information safe and secure and to prevent any unauthorized access to or misuse of the same. NTPL shall not be liable to any User for any loss, damage (whether direct, indirect, consequential or incidental) or harm caused to the User due to the unauthorized access or misuse of the Information by any third party (beyond the control of NTPL).

While NTPL strives to use commercially acceptable means to protect your Personal Information, NTPL cannot guarantee its absolute security.

LINKING TO OTHER WEBSITES

NTPL is not responsible for the privacy practices or the content of any other websites for which links may be provided on the Website, or which provides links to the Website. By clicking on a link, logo or other such items, or using certain services available on the Website, User may no longer be on the Website and in such circumstances privacy policy of such other website shall apply. NTPL encourages Users to read the posted privacy statement of the other websites whenever interacting with any website other than the websites associated with NTPL.

YOUR RIGHTS

Subject to applicable law, including the Digital Personal Data Protection Act, 2023, Users may request access to the Information NTPL holds about them, request correction of inaccurate Information, request erasure of their Information (subject to any legal or regulatory retention requirements), and withdraw previously given consent at any time. Withdrawing consent will not affect the lawfulness of processing carried out before the withdrawal, and may affect your ability to use certain features of the Website.
