These Terms of Use (“Terms”) govern your access to and use of the Gentle mobile application and the services made available through it (the “Website”), operated by NEOGENTLE TECHNOLOGIES PRIVATE LIMITED (“NTPL”). By downloading, accessing, or using the Website, you agree to be bound by these Terms. If you do not agree, please do not use the Website.

The Website provides stock market data, mutual fund and index information, credit score tracking, financial calculators, and related subscription services (“Services”). Users are solely responsible for compliance with all applicable laws and regulations regarding their use of the Website.

User agrees not to use any device, software or routine to interfere with the proper working of the Website or which is intended to damage, interfere with or surreptitiously intercept or expropriate any system, data or personal information. User agrees not to take any actions which may undermine the integrity of the Website.

NTPL reserves the right to change these Terms at any time. Material changes will be notified to registered Users, and continued use of the Website after such changes constitutes acceptance of the revised Terms.

Gentle Pro and Gentle Plus are auto-renewing subscriptions. The length of the subscription (monthly or annual) and its price are shown on the plan selection screen before you confirm purchase.

If you subscribe through the App Store on an iOS device: payment is charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews for the same length and price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage your subscription, view its terms, and turn off auto-renewal at any time in your Apple ID Account Settings, on any device signed into that Apple ID.

If you subscribe through any other supported payment method: your subscription automatically renews for the same length and price unless you cancel it from within the app before the next renewal date. You can view, manage, and cancel your subscription at any time from the Subscription section of the app.

Any unused portion of a free trial period, where offered, is forfeited once you purchase a subscription.

The Website, including its design, text, graphics, logos, trademarks, and underlying software, is owned by or licensed to NTPL and is protected by applicable intellectual property laws. Subject to your compliance with these Terms, NTPL grants you a limited, non-exclusive, non-transferable, revocable licence to use the Website for your personal, non-commercial use.

You may not copy, modify, distribute, sell, or lease any part of the Website, nor reverse engineer or attempt to extract the source code of the Website, except as permitted by applicable law.

If you choose to submit feedback, suggestions, or ideas about the Website to NTPL, you agree that such feedback is given voluntarily and that NTPL may use it to improve the Website without any obligation to compensate you or treat the feedback as confidential. This does not affect any rights you may have over your own personal data, which is handled in accordance with our Privacy Policy.

NTPL processes personal data collected through the Website in accordance with the Digital Personal Data Protection Act, 2023, the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011, and other applicable data protection laws of India. Details of what personal data is collected, how it is used, and your rights in relation to it are set out in our Privacy Policy, which forms part of these Terms.

You represent and warrant that your use of the Website will not breach any contract or obligation owed to a third party, and that any information or content you submit through the Website does not contain viruses, Trojan horses, worms, or any other harmful or malicious code.

Users agrees to indemnify NTPL officers, directors, employees, agents, licensors and suppliers, other users of NTPL's website against any and all expenses, losses, damages and costs, which may be resulting from any violation of all terms and conditions or any activity related to the Users account or any third party claim/action/proceedings including but not limited to those relating to breach of intellectual property rights or confidentiality, by User or any other person accessing the website using the account of the user.

In no event shall NTPL be liable for any direct, indirect, special, punitive, incidental, exemplary or consequential, damages, or any damages whatsoever, even if they have been previously advised of the possibility of such damages, whether in an action under contract, negligence, or any other theory, arising out of or in connection with the use, inability to use, or performance of the information, services, products, and materials available from this site. These limitations shall apply notwithstanding any failure of essential purpose of any limited remedy.

User agrees that NTPL shall not be responsible for any indirect or consequential loss or similar damage, including without limitation loss of profit, loss of revenue or loss of contracts. The limitations of liability under this section do not apply to any damage caused by the liable Users wilful misconduct, gross negligence, breach of confidentiality obligations or infringement Intellectual Property Rights.

User agrees that this agreement shall be governed by and construed in accordance with the laws of the India. Any dispute, controversy or claim arising out of or relating to this Agreement, or the breach, termination or validity thereof shall primarily be settled through negotiation between the parties. In case the dispute cannot be resolved amicably, the dispute shall be finally settled by arbitration in accordance with the Arbitration Rules.
